TERMS AND CONDITIONS OF HIRING  


PICK-UP & RETURN OF EQUIPMENT

Picture Hire Australia's half day rate consists of a maximum 5 hours & a full day rate of maximum 9 hours. The relevant hired equipment is to be returned p.m. on the day of the hire or by prior arrangement no later than 9.00 a.m. the following day, with all batteries fully charged.  To avoid inconvenience to other hirers, any extension of the hire must be arranged prior to termination of the original hire period.  If in the event that equipment is not returned at the end of the agreed hire period, additional charges calculated on full day rates may occur.

 

GENERAL CODE OF CONDUCT
The hirer or persons employed by the hirer are required to keep equipment in safe custody and must ensure it is used in a skillful and professional manner by persons having the appropriate qualifications and experience. The hirer must take all reasonable precautions to ensure that all equipment is not damaged or destroyed.  It is also a requirement that all hired equipment not be left unattended.

 

MALFUNCTION OF EQUIPMENT
Repairs, alterations, modifications, or other such interference with equipment shall be deemed to be misuse.  Any malfunction or damage caused by the hirer directly or indirectly will be charged to the hirer at repair or replacement cost.  Any malfunction of equipment should be reported immediately to Picture Hire Australia.  If the hirer or persons employed by the hirer replaces globes to lighting equipment they must present the faulty parts on return.

 

HAZARDOUS ASSIGNMENTS
Equipment must not be used on any abnormal or hazardous assignments or taken from the ground other than on a regular scheduled flight by a recognized airline without the consent of Picture Hire Australia. Conditions considered to be hazardous, is use of equipment on board watercraft, light aircraft, helicopters, temporary platforms etc.

 

INSURANCE
If loss or damage caused by misuse, mechanical or electrical derangement, exposure to salt water, exposure to dust and sand or confiscation by Customs or other authorities occurs during the term of the hire, the hirer agrees to pay the relevant insurance expenses and handling fees when a claim is submitted by Picture Hire Australia.  The equipment shall be the responsibility of the hirer from the time it leaves Picture Hire Australia's premises to the time it is returned and accepted by Picture Hire Australia. Acceptance does not release the hirer from the responsibility for the loss or damage of equipment.  Equipment must be specially insured for use outside Australia or for irregular or hazardous use.  The hirer is bound by conditions listed in the insurance policy cover of the equipment, and can be made available for perusal.

 

SUB-HIRE
The parties agree that the hirer retain all hired equipment for their sole use and shall not part with the possession of equipment, sub-hire or assign the benefit of this agreement to any other person or corporation without written consent of Picture Hire Australia.

 

LIABILITY
Except for what is considered normal wear and tear of equipment the hirer assumes all responsibility for negligent damage to equipment. Picture Hire Australia's liability for furnishing incorrect or defective equipment to the hirer is limited to a rebate of the rental charge for such equipment.  The hirer indemnifies Picture Hire Australia, it's agents, and employees for any or all losses, damages, injuries, claims, demands and expenses including without limitations, latent and other defects, whether or not discovered by Picture Hire Australia of the hired equipment.  The hirer will not assign, transfer, or sub-let its rights under the hire agreement, will not pledge, mortgage, or encumber the leased equipment or it's rights hereunder and they will not permit the same to be subject to any lien, charge or encumbrance.
